General Body Meeting of the Fiqh Council

The Fiqh Council of North America holds its General Body Meeting along with ISNA Convention in Houston, Texas:

Discussion on some important issues of concern for the Muslims of America

The Fiqh Council of North America (FCNA) held its General Body Meeting during the 55th Annual ISNA convention on the Labor Day weekend in Houston, Texas. The meeting was attended by most of the members of the Fiqh Council on Sunday and Monday, 2-3 September 2018. Those who could not physically join the meeting, participated via conference phone. The Council also invited experts in Islamic medical ethics and Islamic finance.

The agenda included beside organizational issues many fiqhi issues. The Council finalized its Fatwas on three pending issues that were discussed in its meeting in Dallas, Texas in October 2017. The rulings on the following issues will be posted soon.

1. Ruling on Women attendance and participation in the administration of the Masajid: Muslim women should be encouraged to attend the prayers in the Masjid whenever they can. They can pray in the main hall or have a proper separate place for their prayers. Women should also participate in the Masjid boards and administration. The Fatwas elaborates this ruling on the basis of the Qur’an and Sunnah.

2. Ruling on Female Circumcision: FC is not a religiously mandated or recommended practice of Islam. Due to its physical and psychological affects and its general prohibition by law in many countries, Muslims should not practice it. The Fatwa explains this custom, its origin and the status of some Hadith on this subject.

3. Rulings on Organ Donation and Transplantation: Majority of Muslim jurists and juristic councils have allowed Organ donation and transplantation. Organ donation is a charitable act, but the sale of human organs is not permissible. The donors should not give a blanket permission but should specify what organs they want to donate and should appoint a guardian (wali) to supervise. The Fatwa elaborates some more conditions and restrictions.

The Council entertained a number of other relevant fiqhi issues for the Muslims of North America. The fiqh scholars prepared papers and presentations and debated the issues with elaborate discussions using both the primary and secondary sources of the Shar’ah. The rulings are being drafted and will be announced with the approval of FCNA members as soon as possible. Following are issues that were discussed by the scholars.

1. Zakat on retirement accounts (IRA and 401K) and on Child Savings

2. Use of Marijuana for medical purpose

3. Dealing and investing in crypto-currency

4. Removal of life support from the terminally sick patients

5. Divorce decrees issued by the civil courts
